What it boils down to is this: The more technology we have, the more fluidity we have. No better example of this then money transfers.

Before electronic money transfers, the wealth was held in a bank, in cash, treasury notes, or gold bullion. If you wanted to get your money, you had to go to THAT SPECIFIC BANK. Not another branch. Certainly not another bank. That specific building.

When they figured out how to keep relatively secure electronic databases and dynamically update them, you could then withdraw funds from any number of locations, depending upon how many branches a given bank had.

When they figured out how to install ATMs, your ability to access money shot through the roof. Basically anyplace they could run electricty and run a phone line, they could run an ATM. Within 30 seconds you could have 300 bucks cash in your hand. More technology yields more fluidity.

It used to be that if a government wanted to bail another out, they'd have to ship them a boat full of gold, which the country could trade for tangible objects. Nowadays, if a country needs ten million bucks, it can be wired to them in a matter of seconds. Physical borders are meaningless when it comes to information transfers now. Maximum technolgy yields maximum fluidity.

Sure, there are security measures in place. You can't get money into any account with impunity. But there are people who can. They're underground, they're criminals, but they exist.

You may be able to outlaw MP3s. You may be able to get BB to figure out how to scan computers for them and punish criminals. But you'll never eliminate it entirely. There will be people who maintain archaic computers that are designed purely for MP3 manufacturing and distribution.

The only way to eliminate MP3s? Eliminate the technology. Make EVERYONE trade in EVERY computer for specially bundled computers that have the software and functionality of 1991's machines.

And even that won't be enough. Someone will write software for those machines to rip MP3s, and all the shit will happen all over again.

Whether MP3s are legal or not is irrelevant. It's too late for that. The legality should've been wrestled over when they were first figuring out the codec oh so many years ago. The same thing happened when VCRs were first released commercially. The movie industry was having a fit, because people could record movies offa TV. No one would buy movies anymore, they screamed.

But you know what? People bought movies still. The ones they recorded offa TV weren't as high quality as the ones the movie industry offered.

The same goes for MP3s. 128Kbps is not true quality. You don't get "perfect"(by perfect I mean indistinguishable from the original by the human ear) until 192Kbps, and even that's questionable. Some people claim they can still detect the difference.

Now, I realize that the analogy isn't entirely congruous. But the essentials are the same. New technology yields new fluidity, and with it, protests arise. However, it's too late to go back now. Far too late.

The only thing we can hope for is that we're wise enough to manipulate the technolgy in purely beneficial ways.

You go to a libary. On the shelfs are hundreds of books men and women poured hours and hours into writing. The libary purchased these books for cost and then proceded to give them out free. People would come and go taking a book reading it and returning it knowing full well they would not buy it. Sure occasionally a person would read a book and then buy it but these people were few and far between.

Over time hundreds of people would read these books. These people were therefore in a way stealing from the writers and publishers, after all why buy the book when you can read it for free just as easily. So these libarys are now loaning out free books that keep others from buying the book and helping the writers earn a better profit for their work.

That being said i think napster and morpheous are wrong wrong wrong.

See my speeding analogy. Wrong, yes. Get away with? Yes. Heck, it's almost been fully accepted as part of our culture.

Speeding has the additional benny of being dangerous! Woohoo!

Just because a lot of people do stupid, dangerous things, does not make them right.

Additionally, the speeding analogy is flawed from the standpoint that stealing music or software via filesharing is theft (a crime with a victim), speeding is simply a personal transgression of the rules (no victim, unless other crimes are added, such as failure to control one's vehicle, or causing an accident).

Both acts are illegal. Theft, however, is wrong.

And, 'Deth, just because all the other thieves are doing it, is no reason to take up stealing. I don't buy into the idea that if we get everyone to join in our stealing, we can redefine society's take on theft and retroactively justify our reprehensible behavior.

A new standard may, indeed, be on the horizon. Stealing is still wrong, however, even if future means to cope and prevent it are found. Frankly, I'm disturbed by the current trend of thinking that everyone ought to be entitled to everything without having to have the means to support their desires. No one has any right to own music or software they can't or won't afford.

You want more shit? Then go out and get a better job, make more money, and buy it. Whine about the unfariness of it all to someone else; I've got no sympathy for anyone unwilling or unable to earn what they have.

This is a circle arguement. I could make a point here about most records now being ten songs of shit, when you only want one of them. The one that, most likely, isn't released on a single. It's just pointless, this entire thread has been pointless, aside from how damn funny it is.

You should also remember, you're defining Right and Wrong as your Right and Wrong, not ours,

No . . . I'm defining wrong as commiting a crime where you take something that belongs to someone else without paying for it.

It's really too bad you think stealing is okay.

But you'll also have to understand that you can't have a society in which theft is considered okay behavior. Remember, when someone breaks into your house or your car, don't get mad--what they're doing is okay! Hell, don't even bother the police or your insurance company--it's okay!

Bloodsage, but I manage to see things in shades of gray instead of in shades of Black and white, In my opinion, there are varying levels of theft, and what are you going to do about it?

I don't have to worry about getting arrested for "Mp3 Piracy."

I don't need you to question my morals, no matter how questionable they may be.

I don't think the legality should be called into question. It's clearly illegal on some level. And yes, there are varying levels of illegality.

The idea that must be addressed is this: what solution do we have? The technology is out. It's readily and relatively cheaply available. How do we stem the tide?

The only solution I see is a moral revolution: where stealing is once again seen as a crime.

And given the current state and direction of the world, I don't see it happening. I won't say it's impossible, but it's highly unlikely.

Unless you have another solution, I'm stumped.
