Yes, but you, like everyone else, have the ability to download the game when it goes into open beta.
People that generally buy the game in the first week or two will have heard about it anyway and likely follow it -- also likely knowing about this opportunity. This may get those that weren't going to buy right away to go ahead and buy right away anyway. Those that buy the game a month or two later would be behind anyway.
So, you'd be behind, yes...but it is just as bad as you being behind by buying the game at release a week after it came out. Essentially, Blizzard is releasing the game a few days early online-only. It also cuts down on the "50 people want to kill the same rat" effect that this game will have if everyone buys it on the same day.

Ahh, it sounded like after the character wipe, everyone who was currently in the beta would be moved to open. As long as everyone who wants to be, is allowed in the open beta, then Im ok with that.

Except not, since PvP as parce explained it is gank-free. If you attack alliance guards as a hoarde, you can expect to be ganked, but at least by then you're prepared for it.

I was pretty sure that you couldn't attack Alliance people in Alliance areas unless they hit you first, and vise-versa? I was thought that was put in the game to keep newbies from being randomly ganked. :/

There are like two small areas for each side that don't allow ganking. by level 10, you're in gankable areas.

Yes. There's Alliance, Horde, and Neutral areas. Alliance members have immunity in Alliance zones, and will only engage in PvP if they choose to initiate, and vice-versa for the Horde in Horde zones. Neutral zones are free for all areas (though you still can't attack members of the same faction).
