"Separation of church and state" isn't explicitly cited in the constitution, but neither is "The right to a fair trial". Both, however, are guaranteed as a result of the rights that are explicitly cited in the constitution.

The commandments monument was tantamount to establishing an officially recognized religion in that courtroom. America cannot have an officially recognized religion or it ceases to be a free nation and becomes a theocracy.

I agree with your second paragraph, but your first paragraph is wrong. The Constitution does in fact guarantee you a fair trial by an impartial jury of your peers. See the sixth amendment.
