marriage a requirement for motherhood in the state of Indiana,
including specific criminal penalties for unmarried women who do
become pregnant "by means other than sexual intercourse."

According to a draft of the recommended change in state law, every
woman in Indiana seeking to become a mother throu gh assisted
reproduction therapy such as in vitro fertilization, sperm donation,
and egg donation, must first file for a "petition for parentage" in
their local county probate court.

Only women who are married will be considered for the "gestational
certificate" that must be presented to any doctor who facilitates the
pregnancy. Further, the "gestational certificate" will only be given
to married couples that successfully complete the same screening
process currently required by law of adoptive parents.

As it the draft of the new law reads now, an intended parent "who
knowingly or willingly participates in an artificial reproduction
procedure" without court approval, "commits unauthorized
reproduction, a Class B misdemeanor." The criminal charges will be
the same for physicians who commit "unauthorized practice of
artificial reproduction."

The change in Indiana law to require marriage as a condition for
motherhood and criminalizing "unauthorized reproduction" was
introduced at a summer meeting of the Indiana General Assembly's
Health Finance Commission on September 29 and a final version of the
bill will come up for a vote at the next meeting at the end of this
month.

Republican Senator Patricia Miller is both the Health Finance
Commission Chair and the sponsor of the bill. She believes the new
law will protect children in the state of Indiana and make parenting
laws more explicit.

According to Sen. Miller, the laws prohibiting surrogacy in the
state of Indiana are currently too vague and unenforceable, and that
is the purpose of the new legislation.

"But it's not just surrogacy," Miller told NUVO. " The law is vague
on all types of extraordinary types of infertility treatment, and we
wanted to address that as well."

"Ordinary treatment would be the mother's egg and the father's
sperm. But now there are a lot of extraordinary thing s that raise
issues of who has legal rights as parents," she explained when asked
what she considers "extraordinary" infertility treatment.

Sen. Miller believes the requirement of marriage for parenting is
for the benefit of the children that result from infertility
treatments.

"We did want to address the issue of whether or not the law should
allow single people to be parents. Studies have shown that a child
raised by both parents - a mother and a father - do better. So, we
do want to have laws that protect the children," she explained.

When asked specifically if she believes marriage should be a
requirement for motherhood, and if that is part of the bill's
intention, Sen. Miller responded, "Yes. Yes, I do."

As a Hoosier, a Republican, central Committee member of my County party, I must say that this woman needs just resign her seat right now. When I first started reading I expected spin and some BS that was covering up the real deal. However I hate to say that the article was pretty accurate.

I have Met Pat before and she always struck me as a level headed and intelligent woman. I guess I was wrong.

In regards to this specific decision, it certainly looks like they're trying to work toward flat out outlawing homosexuality at the state level. It'd be interesting to hear them elaborate on the reasoning for such a law.

In the end, though, I seriously doubt it will pass.

The, "We can do this because studies show children with two parents of different genders do better," arguement could also be used, for example, to oppress any statistically disadvantaged group--and thus can't stand serious scrutiny. As a matter of fact, it's exactly this kind of absurd reasoning that that whatisname was trying to put down when all the stupid people got offended and called him a racist for his comments about aborting black babies.

Edit: on the other hand, a savvy gay rights activist could argue that a natural consequence of the law is a requirement that the state legalize gay marriage. . . .

I understand all sorts of crazy ass laws are proposed all the time (thong ban, decency standards for Texas cheerleaders) but this is the kind where I believe simply suggesting it should spell political death.

That's such a hollow, talking point laden sentence. 99% of all govenment activity has some sort of inherent bias. If you build a road, you're being 'biased' towards people who own or can own cars, if you build a school (or give out a voucher for that matter) you're being biased towards people who chose to have kids. If you invest in flood prevention research you're being biased towards the engineering profession. If you offer shelter to tornado victims you're being biased towards people who live in tornado areas. Also any government expenditure is technically limiting freedoms by being financed through taxes.

What about expansion of police powers, a trademark of even the non-religious right everywhere? McCarthyism? Exclusion of women from military service? Massive increases in military spending which limit the 'rights and freedoms' of people in the same way expansion of social programs limits them? The War on Porn? Corporate welfare? Lessening quality of air for everyone in order to increase profits for the manufacturing industry? All those limit rights and freedoms in some way and include 'state sanctioned biases' (see above).

But on topic..I could not believe what I was hearing when this was on the news the other night. Even as conservative as Indiana is, I don't see this truly getting passed, but that someone even came up with the idea is frightening in and of itself. It makes me ashamed to acknowledge Indiana as my home state..really, we're not all morons.

Someone will probably jump my ass for saying this, but in my opinion the argument that kids do better is completely subject to the circumstances in which they are raised, and I don't believe that a parents sex life is a factor. I've seen many good kids come out of single parent homes..and some really nasty ones come out of homes with two parents. I think that it has much more to do with the parenting skills of the people involved than their marital statis. What does it matter if the people involved are gay or married or from the fucking moon if they can take good care of the child?
