This guy I know posted a picture of his car in front of his home on a public forum (not his own) without any copy write disclaimer or water mark.

I did a photo shop and switched out his nice car for a clunker. He’s threatening me with copy write law etc sue me etc.. He has no sense of humor.

Anyway since I feel secure that it was in the public domain and therefore is public domain, so I’m not worried. Then I got to thinking Hey! When have I ever been correct about anything and thought maybe I should ask you guys before I get myself in trouble.

The picture is just some other car parked in front of his home which has no house number or name on it.

Thanks.

Technically the manufacturer of his car has the most traction to sue anybody.

However, there's this wonderful thing known as the Fair Use Clause.

In other words, this individual is retarded.

Proposed retort: "Look up the Fair Use Clause, retard."

There's also the minor fact that his image wasn't copyrighted, and copyright law doesn't even work that way to begin with.

Thought I doubt you're in any kind of trouble. For future reference if you change something that is copyrighted in three or more distinct ways it's no longer considered the original work and therefore no longer under copyright.

Amazing what 3.6 nanoseconds with Google will yield.

There are two things you should never seek via the internet: legal or medical advice.

I'm doubting this guy would actually go throught the time/money of taking you to court over this, whether he actually had a case or not.

Actually, that's a myth. There is no requirement to be making money or to publish someone else's work in order to violate copyright. And fair use is more restrictive than most people think. Neither of the examples you gave, for example, would be fair use.

Actually, that's not always true, either, though more for trademarks than for copyright. Trademarks can be lost if not defended.

It rather irritates me when an artist says "No you CAN'T alter or use ANY of my art work for ANYTHING, don't even bother ASKINg 'cuz I'll just say NO." That's just...scary, and conceited to me. I mean, you can't even ask...? What are thy so morbidly afraid of?
On the othr hand, I don't blame artists at all who don't want people taking their art and doing whatever with it, without permission or even telling the artist about it. If I didn't misunderstand Ares and she really doesn't mind people taking her art, then she is the exception to the rule. Most artists are very angered by it.

There are several reasons a lot of artists are like that, and few of them have anything to do with conceit.

And appearances can be deceiving. As even if the asking of permission seems innocent enough, that you dont give it a second thought, and say go ahead, it can come back to bite you in the ass in a very big way.

So really, I wouldn't go blanketing something like that.

Okay, it's incredibly asinine to chase down a copyright infringement when little to no money is involved, especially considering it's historically been an economic tool.

I didn't say that they necessarily say "no" out of arrogance. It's merely so annoying when one has found the perfect sigpic, forum avatar, etc., but has absolutely no chance of obtaining permission to use it.

And if you're saying most artists don't mind if people use their work without permission, then I don't know who you are friends with, but the several hundred artists [i]I've[/i} conferred with on the matter do not hold your same opinion. Note, I did say "if."

No, I'm merely saying you made a blanket statment on the conceit of artists without having a clue why many are even like that. Who my friends are, or aren't, doesn't really matter. You obviously are superior with your hundreds of artist contacts that you have dealt with. Much like celebrities, I guess artists should feel required to bend to your whims and views on how they contribute to satisfy you in order for you to be happy about it.

I already gave one example of why many artists are the way they are about thier artwork, I could give you many more, but you hurt my brain and it would be a waste of time. For your reference though, almost all artists keep what they call junk work which they throw out there for just about anything. Most artists will only get vehemently protective of special works, characters, or pieces along those lines.
