Actually, it will almost certainly go to the Supreme Court, as the Prop 8 nutters will appeal this decision. It remains unclear if Court will even hear the case. Still, it's conceivable that all those gay marriage bans could be overturned as early as next year.

Yeah, I think that the two most likely outcomes are the court declines to hear the case, or if they hear it, that they rule that the 9th Circuit ruled appropriately. In such an event, it would make gay marriage legal in California and prevent California or any other state which has legalized gay marriage from instituting a ban, but it wouldn't affect the 41 states with constitutional or legislative bans on gay marriage already in place.

I realize that it's likely more complicated than that, but it's a very silly law.
It's only when these agencies choose to deny that license for political reasons that we realize a problem exists at all.

If the court hears it, I'd also expect Justice to weigh in with an amicus brief defending Prop 8, since an adverse ruling might also take down the Defense of Marriage Act.
Indeed; that's why I suspect the ruling will boil down to the following: "You can't take away a right that you've already granted without a damn good reason, and Prop 8 has failed to demonstrate a good reason. So fuck all them bitchass mothfuckas, gays is getting married in California again."
Since the 41 states with marriage bans, as well as the Federal government, have never granted the right for gays to get married, they will, unfortunately, remain unaffected. The nice side effect, though, is the six other states that do have gay marriage will not be able to take that right away.
Eh, it's a shitty middle ground, but at least there would be a handful of states where the rights of gay people could no longer by shat upon.
