he got charged with a crime thats not on the books? or is it on the books and they never have charged anyone with it before.

will the defense that he had a resonable expectation of privacy in his care be accepted?

I am guessing this would fall under reckless driving, hence the reason for the charge.

Very public. I've been driving before and the vehicle in the right lane two car links ahead of me can have a movie going and I can tell what it is.
