Actually, it's a gray area. In most states, the age of legal consent is 16, and the national age of majority is 18. That means that you can legally have sex at 16, but you can't be filmed having sex (or smoke a cigarette after) for another two years.
Because of that, statutory rape laws really only affect kids under the age of legal consent (IE 15 and under), and are only enforced when it's not a violent rape (which usually falls under harsher-penalty laws). That having been said, a 16 year old is legally old enough to consent to have sex with anyone 16+. However, I don't know that it's a terribly brilliant idea. Broadly speaking, when you get to be around my age or so (24), you start to realize that while it was fun to have sex when you were 16ish, you weren't really ready to deal with (at 16) the consequences that having sex could have ended up leading to (IE a baby, the disruption of your education which is even more vital, the robbing you of your solo "you" time before settling down, etc).
So would I castrate a 22 year old guy seeing a 16 year old? Nope. Would I as a parent want my 16 year old, minor daughter who I am legally and financially responsible for sleeping with a 22 year old who has greater opportunities to leave if things go south, no matter what he professes to feel for her? No, I wouldn't.

If she means that much to you, wait a couple years. Chaperone of some sort = good idea.
But thats just me.
I think the main reason situations like that are frowned apon is cause people believe that they are doing it just for sex, which is of course Illegal.
